STC's Supreme Committee for Legal Affairs Appreciates Administrative Tribunal Judgement to Suspend Execution of Prime Minister's Resolution No. (3)

The Supreme Committee for Legal Affairs (SCLA) of the Southern Transitional Council (STC) held its periodic meeting on Thursday, chaired by Prof. Dr. Saad Mohammed Saad, head of the committee, which was devoted to discussing the ruling of the Administrative Court in the capital, Aden, to suspend the implementation of Prime Minister’s Resolution No. (3) of 2023 on raising the price of the customs dollar and its negative impact on the life and livelihood of citizens of the South.

While the SCLA commended the administrative court’s judgment to cease that resolution, at the same time it has emphasized the necessity of following judicial procedures to implement the court's decision on the ground by obliging the implementing authorities to comply with the court’s judgment until deciding on the case and not to leave Judgement enforcement to the Prime Minister.

The meeting stressed the case for annulment of administrative decision No. (3), which, like other lawsuits relating to cancellation of administrative decisions, should not depend on the presence of the party that issued the decision, as it is not a case directed against a person but against the decision itself that violates the law, and so that the intransigence of the defendant (the Prime Minister) is not a reason for procrastination and prolongation of litigation.

The meeting, too, reviewed the remaining topics on its agenda, especially the ongoing arrangements to declare the Southern Bar Association (SBA) and effectively contribute to finding quick solutions to the deteriorating conditions in the branches of the association in the governorates of the South, in addition to approving the final draft of the annual plans of its departments for the year 2023.
